Diversion of part of footpath Lancaster 55 and stopping up of an unrecorded footpath

Public path diversion and stopping up order 2019

On 28 November 2019 Lancaster City Council confirmed the above Order. The effect of the Order will be to divert the public footpath running from point A (grid reference SD 4804 5889), running south south east for 30 metres to the junction with an unrecorded public footpath at point B (SD 4805 5886) then generally south for 60 metres to the junction with Oakwood Gardens at point C (SD 4805 5881) and to stop up  an unrecorded public footpath commencing at point B (grid reference SD 4805 5886), running generally south east for 30 metres to the junction with the new footpath at point D (SD 4806 5884) as shown on the Order Map  as a bold black line and the Part of Footpath 55 running from point A (SD 4804 5889) to point C (SD 4805 5881) shall be diverted to the line shown by bold black dashes shown on the Order Map commencing at point A (grid reference SD 4804 5889), running generally south south east for 75 metres to point E (SD 4807 5883). This is set out on the Order Map (pdf).

The Order comes into force on the date on which Lancaster City Council certifies that the alternative highway has been created to its reasonable satisfaction but if any person aggrieved by the Order desires to question its validity or that of any provision contained in it on the ground that it is not within the above Act, or on the ground that any requirement of the above Act or any regulation made under it has not been complied with in relation to the confirmation of the Order, he or she may apply to the High Court for any of those purposes under section 287 of the Town & Country Planning Act 1990 within 6 weeks from 6 December 2019.
